**Privacy Notice Continental Best**

In compliance with the FEDERAL LAW FOR THE PROTECTION OF PERSONAL DATA HELD BY PRIVATE PARTIES dated July 5, 2010 (hereinafter the “Law”), the following Privacy Notice, the “Notice”, is issued.

CONTINENTAL BEST, S.A. DE C.V. (hereinafter CONTINENTAL BEST), is concerned about the confidentiality and security of its customers’ and friends’ personal data and is committed to protecting their privacy and complying with applicable legislation on the protection of personal data held by private parties.

The terms used in this Notice shall have the definitions assigned to them by the Law. This Notice specifies the type of data that CONTINENTAL BEST collects, the purposes for which it processes them, as well as the rights that the data subject has in this regard.

**FIRST. RESPONSIBLE PARTY.-** CONTINENTAL BEST, S.A. DE C.V., is the person responsible for collecting personal data, their use, and protection. Likewise, it will be the person who will process requests from data subjects to exercise the rights referred to in the Law. “CONTINENTAL BEST, S.A. DE C.V.” has its address at Homero 425, Colonia Chapultepec Morales, Mexico City, Miguel Hidalgo Delegation CP 11570.

**SECOND. PERTINENCE OF THE DATA.-** The information obtained from data subjects is presumed to be pertinent, correct, up-to-date, and useful for the purposes for which it is collected and intended. The data subject is solely responsible for the truthfulness and suitability of the information provided to the Responsible Party.

CONTINENTAL BEST’s data collection is done in good faith, and for this reason, it assumes that the data are truthful, correct, complete, and identify the data subject who provides and/or supplies them, so it is the responsibility of the data subject to ensure that the data provided to CONTINENTAL BEST meet such characteristics and are updated as required. Similarly, CONTINENTAL BEST reserves the right to take appropriate actions in case of data falsification.

**THIRD. CONTENT OF PERSONAL DATA.-** In accordance with the Law, “Personal Data” is understood to mean any information concerning an identified or identifiable natural person. For the purposes of this Privacy Notice, but not limited to, the following shall be understood as “Personal Data”:

**3.1. General data**

Names and surnames, date of birth, gender, marital status, existence or not of children, address, landline (home or office), cell phone, and email.

**3.2. Financial or asset data per transaction**

When you carry out product purchase transactions, register for events, or participate in promotions, whether through the telephone customer service center (“call center”) or through sites (PAY PAL) and micro websites, in addition to general data, data related to bank cards shall be considered Personal Data, such as cardholder name, card number, card expiration date, card type, security code, as well as the delivery address of the product and any other information necessary to carry out the transaction by telephone or online. Also considered personal data are those related to bank accounts, such as the account holder’s name, bank name, Standardized Banking Key (CLABE), and any other information necessary to make payments for royalties, commissions, or promotions.

Likewise, data related to investigations carried out to grant credit to potential clients, such as personal credit references, are considered personal data.

**3.3. Sensitive Personal Data**

In terms of the Federal Law on Protection of Personal Data Held by Private Parties, CONTINENTAL BEST will not collect sensitive data.

**3.4. Social Networks**

Social networks (such as Facebook® and Twitter®, among others) constitute a platform for communication and interconnection between digital platforms of different users, are external to CONTINENTAL BEST and, therefore, are not under its responsibility.

The information provided within social networks in which CONTINENTAL BEST participates as a user does not constitute nor is part of the Personal Data subject to the protection of this Privacy Notice, being the responsibility of the platform provider company and the person who publishes it.

The Personal Data mentioned in sections 3.1. to 3.3. of this Notice will be collected by filling out Contracts, Agreements, various forms and/or by collecting information or documentation required by CONTINENTAL BEST, either in person, by telephone, by optical means or by any other technology, as well as electronically on any of the present or future CONTINENTAL BEST websites (“CONTINENTAL BEST websites”), among which the following stand out: www.continentalbest.com

**3.5. Cookies**

Cookies are text files that are automatically downloaded and stored on the user’s computer hard drive when browsing a particular Internet page and allow the Internet server to remember some user data.

Through this Privacy Notice, we inform you that we DO NOT use cookies.

**FOURTH. TREATMENT OF YOUR PERSONAL DATA.-** In accordance with the provisions of the Law, Data Processing (“Data Processing”) is considered to be the obtaining, use, disclosure, or storage of Personal Data, by any means. The use encompasses any action of access, handling, use, transfer, or disposal of Personal Data.

The Treatment of Personal Data by CONTINENTAL BEST shall be limited to the fulfillment of the Treatment Purposes provided for in this Privacy Notice and shall be subject to the following:

a) In the event that it is intended to process your Personal Data for a purpose other than the purposes of this Privacy Notice, CONTINENTAL BEST shall require your consent for such purpose, again.

b) It shall be necessary, adequate, and relevant to the purposes described in this Privacy Notice.

**FIFTH. PURPOSES OF PERSONAL DATA PROCESSING.-** Through this Privacy Notice, CONTINENTAL BEST declares that the purposes of processing your Personal Data shall be as follows:

a) Commercial purposes, in order to provide you with commercial information from CONTINENTAL BEST, including trivia, promotions, contests, information about new products, birthday congratulations, changes in our products, request for service quality evaluation, conduct internal studies on consumption habits, and any other promotional or matter related to the products and/or services that are part of the business.

b) Online transaction collection, in order to make economic charges to the bank cards of products purchased by CONTINENTAL BEST customers, derived from the purchase of products or services from the company.

d) Economic purposes, when requesting the granting of credits by the company, such as personal or credit references before credit institutions endorsed by law.

**SIXTH. ACCEPTANCE OF PERSONAL DATA PROCESSING.-** For CONTINENTAL BEST to be able to carry out the Processing of Personal Data, our customers and/or Personal Data subjects must grant us express or tacit acceptance for such processing, which shall be carried out by any of the following means:

6.1. Acceptance through electronic means

a) Publication on CONTINENTAL BEST websites

In addition to informing you of the Privacy Notice by email, CONTINENTAL BEST will publish this Privacy Notice on its website, in order for you to give or deny your consent for CONTINENTAL BEST to carry out the Processing of your Personal Data, once you become aware of its content.

This will also apply in case, for any reason, CONTINENTAL BEST does not have your

email address, as long as you access CONTINENTAL BEST websites.

b) Bulletin boards on CONTINENTAL BEST websites

In addition to the publication of this Privacy Notice on CONTINENTAL BEST websites, it will be included on the bulletin boards, in order to inform you of the content of this Privacy Notice and, therefore, that you may give or deny your consent for CONTINENTAL BEST to carry out the Processing of your Personal Data, once you become aware of its content.

6.2. Express acceptance

It will be understood that you have tacitly accepted the Processing of your Personal Data in accordance with the terms of this Privacy Notice if you do not express opposition to it, either by sending an email to CONTINENTAL BEST or through any other means of communication indicated in this Notice, within 15 (fifteen) days following the publication of this Notice, either in the email sent by CONTINENTAL BEST to you, by the publication on the CONTINENTAL BEST website, or by the inclusion of this Privacy Notice in the bulletin boards of the CONTINENTAL BEST websites.

**SEVENTH. LIMITATION OF USE AND DISCLOSURE OF PERSONAL DATA.-** CONTINENTAL BEST shall keep confidential the Personal Data provided by its customers, subject to the exceptions provided for in the Law.

**EIGHTH. ARCO RIGHTS.-** In accordance with the Law, you have the right to access, rectify, cancel, or oppose the processing of your Personal Data (“ARCO Rights”).

**Access Rights:** You may request access to the Personal Data held by CONTINENTAL BEST, as well as information regarding the conditions and generalities of its Treatment.

**Rectification Rights:** You may request the rectification of your Personal Data if it is inaccurate or incomplete.

**Cancellation Rights:** You may request the cancellation of your Personal Data when you consider that it is not being used in accordance with the principles, duties, and obligations set forth in the Law.

**Opposition Rights:** You may oppose the Processing of your Personal Data for specific purposes.

The ARCO Rights are free, and the mechanisms that have been implemented for the exercise of such rights shall be free of charge, with the exceptions provided for in the Law.

The exercise of the ARCO Rights must be made by written request sent to CONTINENTAL BEST, to the email address indicated in this Notice.

**NINTH. LIMITATION OF USE AND DISCLOSURE OF PERSONAL DATA.-** CONTINENTAL BEST shall keep confidential the Personal Data provided by its customers, subject to the exceptions provided for in the Law.

**TENTH. CHANGES TO THE PRIVACY NOTICE.-** CONTINENTAL BEST reserves the right to make modifications or updates to this Privacy Notice at any time, in order to adapt it to new legislation, internal policies, or new requirements for the provision or offering of CONTINENTAL BEST products or services. Any modification to this Privacy Notice shall be communicated through any of the means established herein.

**ELEVENTH. JURISDICTION.-** The parties agree to submit any dispute arising from the interpretation or execution of this Privacy Notice to the competent courts of Mexico City, Federal District, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles, or for any other reason.

**TWELFTH. APPLICABLE LAW.-** This Privacy Notice is governed by Mexican law.
